Leaky foundation at Cypress home subject of lawsuit
At the heart of a Harris County lawsuit is a leaky foundation and a homeowner's alleged failure to disclose it.
Robert Monroe filed a lawsuit on Sept. 22 in the Harris County District Court and is claiming Austin and Shannon Davis sold him a home without mentioning the property's water problems.
The suit alleges that the home, located at 12602 E. Shadow Lake in Cypress, suffered from water penetration during the time it was owned by the defendants. When the couple sold it to Monroe, they negligently misrepresented the condition of the home's foundation, Monroe claims.
In fact, the couple stated in the seller's disclosure that there were no problems with the foundation or with penetration, the suit claims.
Monroe is being represented by Houston attorney Terry B. Joseph. He is seeking compensatory damages and attorney's fees.
