Cy-Fair company sued for alleged unfair fees

A Montrose woman is suing a Cy-Fair association, a property manager from Spring and a Cy-Fair asbestos company, alleging that the condo where she lived did not have the proper insurance to cover damage from Hurricane Ike.

The woman also alleges that she was charged unfair maintenance and assessment fees to fix other units, and had her home entered by workers despite not giving permission.

 

Debra Jo Catlett filed a lawsuit on Oct. 12 in the Harris County District Court against AMI Association Management Inc., Parc Condominium Association, Frank Cario, of Spring, Environmental Solutions Inc. and AAR Inc., of Cy-Fair, alleging breach of contract and wrongful entry.

 

Catlett, who owns Unit #202 of Parc IV Condominiums, says that she has been paying maintenance and assessment fees, but the money is not going towards raising the insurance to cover future hurricanes. The defendants are also charging 133 percent more in these fees since Hurricane Ike, and allegedly spending the money to upgrade other units. 

 

Catlett alleges that on Oct. 13 and Oct. 14, workers from AAR and Environmental Solutions entered her apartment to do asbestos work, without her permission, and the latter continued to do work, even after she insisted they leave. 

 

The plaintiff is seeking damages including actual damages of money paid, loss of property value, court costs and any other damages they are entitled to by the court. She also wants a new board to be put in place, a new management company and all contractors to be replaced.

 

Catlett is representing herself in this matter.
