A Cy-Fair lumber company is suing a Katy man and his company, who it says has not paid it for more than $5,700 worth of lumber he delivered.

Masons Mill & Lumber Co. Inc., filed a lawsuit on Oct. 14 in the Harris County District Court against Wiesner Homes LLC and Ed Wiesner Jr., alleging breach of contract.

The plaintiff says that beginning in April 2010, it delivered lumber to the defendant that totaled $5,716.58, and the defendant is refusing to pay what is owed.

The plaintiff is seeking damages including actual damages, interest, court costs and any other damages they are entitled to by the court.

The plaintiff is being represented in the case by Houston attorney G. Scott Fiddler.
