Subcontractor sues over Cy-Fair ISD work
A subcontractor is suing for nonpayment of work on a Cy-Fair ISD project.
The subcontractor is suing, alleging its contractor withheld $8,490 for the labor and materials it contributed to the project.
Kirby Restaurant Equipment and Chemical Supply Co. filed suit in Harris County District Court stating that Drymalla Construction Co. and Federal Insurance Co. breached their contracts when failing to pay Kirby Restaurant Equipment and Chemical Supply Co. the $8,490 it owed for labor and materials provided for a Cy-Fair ISD project.
In the suit, Kirby Restaurant Equipment and Chemical Supply Co. allege financial damages caused by Drymalla Construction Co. and Federal Insurance Co.'s refusal to pay for the work contracted.
It was the responsibility of Drymalla Construction Co. and Federal Insurance Co., it says, to honor the contract by paying for the work done by Kirby Restaurant Equipment and Chemical Supply Co.
Kirby Restaurant Equipment and Chemical Supply Co. is being represented by San Antonio attorney Stephen J. Johnson. It is seeking $8,490 plus interest, court costs, and attorney's fees.
