Couple files suit over falling cabinet
A Cy-Fair couple is suing its apartment complex and a cabinet maker, stating they aggravated the woman's blood-clotting disorder.
Courtney and Johnnie Smith filed a lawsuit on Nov. 15 in the Harris County District Court against Vintage Park Apartments and Republic National Cabinet Corp. citing negligence, breach of implied warranty, fraud in the inducement, breach of contract and loss of consortium.
The couple says that in December of 2008, a 100-pound cabinet fell off the wall of their leased apartment at 15727 Cutten Road, hitting Courtney on the chest, arms and leg. The injuries sustained aggravated her blood-clotting disorder and put her unborn child at risk. The plaintiffs say the defendants knew of the unsafe condition of the cabinets but failed to repair them.
The Smiths are seeking compensatory damages, court costs and attorney's fees. They are being represented in the case by Houston attorney Joe Rentz.
