Lopez says that in May of 2010 he was working on a construction project at the H-E-B Grocery Co., located at 4625 Windfern Road, when an employee of the store dropped boxes on him while operating a forklift. According to the brief, the severity of Lopez's injuries required him to be hospitalized.

Lopez is seeking $100,000 in damages, attorney's fees and court costs.

He is being represented in the case by Pasadena attorney Enrique Dovalina.
