Cy-Fair man sued over car problems

A man is suing after having his 2006 GTO repaired and rebuilt.

Alexander Vinogradov filed a lawsuit on Dec. 10 in the Harris County District Court against Gary Harmon and Horsepower Enterprises, located at 11950 Perry, alleging breach of contract, violations of the Texas Deceptive Trade Practices Act, negligence, conversion and fraud.

Vinogradov states that in November 2009, he contracted with the defendant to repair and rebuild his 2006 GTO. He says that about two weeks after he picked up the car from the defendant’s shop, he discovered it was leaking oil. According to the brief, by March of 2010, the motor, which had been rebuilt by the defendant, blew. Vinogradov says that the defendant offered to replace the engine and pistons, but after tearing the motor apart, refused to finish the work. He says he was forced to pick up his car in pieces.

Vinogradov is seeking actual, compensatory and special damages, as well as attorney’s fees and court costs.

He is being represented in the case by Houston attorney Claude Davis III.
