Cy-Fair assisted-living facility sued
A woman is suing after, she says, her brother deceived their mother into appointing him as her power of attorney, then leaving her, against her will, in an assisted-living facility.
Dawn Koetter filed a lawsuit on Dec. 21 in the Harris County District Court against Silverado Senior Living of Cypress and Jeffrey Wyatt, of 5703 Capella Park Drive in Spring, alleging false imprisonment, intentional infliction of emotional distress, fraudulent inducement and breach of fiduciary duty.
Koetter says that on Dec. 13, Wyatt drove their unsuspecting mother to Silverado Senior Living of Cypress to enjoy lunch and tour the facilities. According to the brief, after lunch, Koetter left their mother there against her will. Koetter says her brother did this to gain control of their mother’s finances. Her mother has been detained in the home since Dec. 12, and she says it will not allow her to visit.
Koetter is seeking actual and exemplary damages, as well as attorney’s fees and court costs.
She is being represented in the case by Houston attorney James Evans.
