Cy-Fair business sues Memorial resident and others over materials, labor

An electrical supplier is suing after, it says, businesses conspired to drain a debtor’s assets in order to avoid paying outstanding invoices.   

Cy-Fair company Crawford Electric Supply filed a lawsuit on Jan. 20 in the Harris County District Court against Teton Buildings, PKI Management, P-K Interests and Memorial resident Maher Touma, alleging breach of contract, fraud in the inducement, negligent misrepresentation, conversion, fraudulent transfer, conspiracy to commit fraud and sham to perpetrate fraud.

Crawford Electric says that in July of 2009, the defendants negotiated an asset purchase agreement in order to avoid paying unsecured debts. According to the brief, the defendants schemed to mislead suppliers, distributors and vendors by conducting business as usual, although the asset transfer made them incapable of paying off debts owed to the plaintiff.

The plaintiff is seeking actual damages in the amount of $227,722.35, exemplary damages, attorney’s fees and court costs. It is being represented in the case by Houston attorney Matthew Moore.
