Cy-Fair company sues former employee over non-compete agreement

A company in Cy-Fair is suing a former employee over customer lists, price lists and marketing plans.

XPress Business Products of Cy-Fair filed a lawsuit on March 21 in the Harris County District Court against John Breen, alleging breach of contract and misappropriation of trade secrets.

XPress says that on Sept. 10, 2010, Breen signed a non-disclosure and non-compete agreement, promising to keep information -- including employee lists, customer lists and marketing plans -- confidential. XPress claims that when Breen resigned from the company on March 7, he breached this contract by using XPress’ trade secrets to actively solicit clients.

XPress is seeking injunctive relief, actual and exemplary damages, attorney’s fees and court costs. It is being represented in the case by Houston attorney L. Andrew Dunham.
