Cy-Fair neighborhood sues over allegations of menacing pit bull

A Cy-Fair community association is seeking injunctive relief in an attempt to force a resident to restrain her freely roving pit bull. 

Enclave by Texas Casador Community Improvement Association filed a lawsuit on May 12 in the Harris County District Court against Michael Clark and Pamela Ashley, alleging violations of the Texas Property Code.

The plaintiff says that residents of its neighborhood, located at Linpar Court in Cy-Fair, feel threatened and frightened because defendant Ashley refuses to keep her pit bull leashed. According to the brief, the defendants are violating the subdivision’s deed restrictions by letting the pit bull run loose, creating a nuisance and a threat of danger.  

The plaintiff is seeking injunctive relief, attorney’s fees and court costs. It is being represented in the case by Houston attorney Dennis McQueen.
