Cy-Fair robbery triggers lawsuit

Farmers Insurance Exchange is being sued over allegations it failed to cover claims relating to a robbery in Cy-Fair. 

Lilly Proba and Pro Audio Motors filed a lawsuit on May 12 in the Harris County District Court against Farmers Insurance Exchange, citing breach of contract, breach of duty, unfair settlement practices and violations of the Deceptive Trade Practices Act.

Proba says that Farmers Insurance Exchange failed to cover her losses after Pro Audio Motors, located at 6650 Highway 6 South in Alief, was robbed on Sept. 13, 2008. According to the brief, the defendant insured the store, but violated the terms of their contract by failing to cover losses related to the burglary. 

The plaintiffs are seeking at least $149,792.37, plus punitive and exemplary damages, as well as attorney’s fees and court costs. They are being represented in the case by Houston attorney Mark Rubal.
