Cy-Fair company sues over manufacturing equipment
A Cy-Fair company is suing after, it says, the equipment it ordered from a Michigan company was not satisfactory.
Cy-Fair’s Timeco Machine Works filed a lawsuit on June 8 in Harris County District Court against S & M Machinery Sales and DFW Movers & Erectors, alleging breach of contract, fraud, fraud in the inducement, and breach of express and implied warranties.
Timeco Machine Works says that on June 28, 2007, it purchased a $70,000 Mori Seiki turning center and a $132,500 Mori Seiki Vertical Machining Center -- with coolant, tank, pump and manuals -- from S & M Machinery. According to the brief, S & M Machinery shipped this equipment without manuals and essential parts, making it impossible to set up, test and use.
Timeco Machine Works is seeking actual, consequential and exemplary damages, rescission of the contract, attorney’s fees and court costs. It is being represented in the case by Houston attorney Tammy Tran.
