Employee files suit against Cy-Fair metal yard

A Brazoria County man is suing his employer after allegedly falling off a ladder while working at a Cy-Fair scrap metal yard.

Donald Ray McKinney filed the lawsuit July 18 in Harris County District Court against South Side Scrap Metal L.C. and Dearth Brothers Inc., also known as D.B.I. Transport Service.

McKinney says he was working for Dearth Brothers at CFF Scrap Metal in July 2009. The man claims he slipped off the steps of a ladder and hurt his neck and shoulder.

McKinney contends Dearth Brothers is negligent for allegedly failing to provide a safe work environment and is therefore liable for his injuries. He is asking his employer to pay an undetermined amount of money in damages for medical expenses, loss of income and court costs.

McKinney is represented by attorney Loren G. Klitsas, of Houston. They ask for a jury trial.
