Cypress man sued over skid steer sale

A Cypress man is being sued over claims he lied about the condition of a skid steer in order to make a sale.
 
Patton Ranch LLC and Daniel Patton filed a lawsuit on Nov. 10 in the Harris County District Court against Glenn Kimberling, of Cypress, citing violations of the Deceptive Trade Practices Act, breach of contract, and fraud.

The plaintiffs say on May 5, they unknowingly purchased a defective Case 90 XT Skid Steer from Kimberling.

According to the brief, Kimberling assured the plaintiffs the skid was in good condition, although it had been known to leak hydraulic fluid.

The suit alleges Kimberling covered up the fact that the skid had many problems and would require a new engine.

The plaintiffs are seeking actual and exemplary damages, as well as attorney’s fees and court costs. They are being represented in the case by Houston attorney Samuel Griffin, III.
