Cy-Fair man sued over alleged dog attack
A Cy-Fair man is being sued over claims his dog attacked a wheelchair-bound man and the man’s personal assistance dog.
Mark Imm filed a lawsuit on Jan. 9 in Harris County District Court against Mansions at Hastings Green, Cy-Fair resident Vontrell Burton and others, citing negligent handling of an animal, negligence per se, malice and gross negligence.
The suit alleges that on Jan. 12, 2010, Burton’s unleashed dog attacked Imm, who is wheelchair-bound, and his leashed assistance dog, while they were in the common area at Mansions at Hastings Green. Imm says before the attack, he asked Burton to restrain his dog, but Burton refused.
After the attack, Burton retrieved his dog and left without helping Imm, but then returned to the scene and set the dog free again, allowing the dog to attack Imm’s assistance dog a second time.
Imm is seeking actual and exemplary damages, as well as court costs He is being represented in the case by Houston attorney Amber Mostyn.
