Cy-Fair L.A. Fitness blamed for broken tibia, torn ligaments
L.A. Fitness is being sued over claims a personal trainer at its Cy-Fair location caused a client to break her tibia.
Shantelle and Brian Wischnewsky filed a lawsuit on Jan. 9 in Harris County District Court against L.A. Fitness and Nien “Bob” Nguyen, citing negligence, negligent hiring, violations of the Deceptive Trade Practices Act and gross negligence.
The plaintiffs say on Jan. 19, 2010, Mrs. Wischnewsky broke her right tibia and tore every ligament in her right ankle while working with a personal trainer at L.A. Fitness, located at 6386 North Eldridge Parkway in Cy-Fair.
According to the brief, the accident happened when Nguyen, her personal trainer, instructed her to jump over a squat pad. The suit further alleges that after the incident, neither Nguyen nor any other L.A. Fitness employee offered Wischnewsky any help.
The couple is seeking damages, attorney’s fees and court costs. They are being represented in the case by Nicola Thompson Drake.
