Tomball fire sparks lawsuit against Cypress contractor

A couple is suing a Cypress-area deck builder after a fire damaged their home in Tomball.

Peerless Indemnity, as subrogee of Tomball residents Scott and Patricia Ramey, filed a lawsuit on Feb. 9 in Harris County District Court against Matts Custom Decks, of Cypress, citing negligence and breach of warranties.

Peerless Indemnity says on Sept. 15, 2010, a garage fire damaged the Ramseys' Imperial Creek Drive home. According to the brief, in the summer of 2010, the couple hired Matts Custom Decks to add a patio, complete with lights and fans, to their home, and the fire was most likely caused by wiring insulation damaged by the company.

The plaintiff is seeking damages and court costs. It is being represented in the case by Houston attorney Jason Schulze.
