Cypress man sues Katy bar over drunk-driving accident

A Cypress man is suing a Katy-area bar, and others, after his daughter was killed by a drunk driver on North State Highway 6.

Cypress resident Mark Anthony Rodriguez and others, on behalf of the deceased Christa, also known as Krysta Rodriguez, filed a lawsuit on Feb.10 in Harris County District Court against The Bayou Sports Bar and Grille, in Katy, and Thomas Christopher Boyd, among others, citing negligence, gross negligence and negligence per se.

Rodriguez says at 2:25 a.m. Feb. 11, 2010, an allegedly intoxicated Boyd killed Ms. Rodriguez when he drove his 2003 Dodge Ram into the passenger side of a car while speeding in the 8500 block of North State Highway 6. According to the brief, Boyd had been drinking alcohol at The Bayou Sports Bar and Grille since 11 p.m. Feb. 10, 2010 and left the bar in an obviously drunken state at 2 a.m., 25 minutes before the accident.

The suit alleges employees at Bayou Sports Bar continued to serve Boyd even though it was clear he was intoxicated and unable to safely operate a vehicle.

After the accident, Boyd’s blood alcohol content tested three times the legal limit, Rodriguez claims.

Rodriguez is seeking damages, attorney’s fees and court costs. He is being represented in the case by Richmond attorney Heather Wagner.
