Worker crushed to death in Cy-Fair, estate sues

A Cy-Fair company is being sued over claims its failure to follow OSHA guidelines caused an employee's death.

Reina Escobar, individually and on behalf of the deceased Xavier Hernandez, filed a lawsuit on Friday, April 13 in the Harris County District Court against Arsham Metal Industries, citing negligence and gross negligence.

Escobar says on March 10, Hernandez was crushed to death during a workplace accident at 11280 Charles Road in Cy-Fair. According to the brief, a stack of metal blocks, weighing 100 pounds each, fell on top of him as he stood on a loading platform scale.

Escobar claims the way in which Arsham Metal stored the metal blocks violated OSHA standards.

The plaintiff is seeking damages and court costs. She is being represented in the case by Dallas attorney Clay Miller.
