Chicas says 63-year-old Santiago Chicas died after falling off a ladder March 17 while cleaning out the gutters of Waters' residence, located in the 40 block of Windermere Lane in Memorial.

The defendants knew the job could be dangerous and failed to provide a safe work environment for Chicas, the plaintiffs claim in the brief.
